Opting NRI quota in MBBS admissions: HC extends deadline for 10 days

Senior advocate Kurian George Kannanthanam submitted that the candidates are allowed to change their subjects or to add on to it, in supplementation of their original options, but when it comes to opting for NRI seats, the CEE has taken a stance that it will cause a delay in the verification process.

KOCHI: The Kerala High Court has ordered the Commissioner for Entrance Examinations (CEE) to allow candidates who have applied for MBBS admissions to choose the NRI quota for 10 more days.
Justice Devan Ramachandran ordered that all candidates should be allowed to choose their options for 10 days from August 5th. The court issued a general directive after considering two petitions (WP-C Nos. 24275, 24942/2022) filed by candidates challenging the denial of permission to choose the NRI quota by the CEE for 2022-23 MBBS admissions.

Senior advocate Kurian George Kannanthanam submitted that the candidates are allowed to change their subjects or to add on to it, in supplementation of their original options, but when it comes to opting for NRI seats, the CEE has taken a stance that it will cause a delay in the verification process. The excuse given by the CEE can only be seen to and nothing more as the results of the NEET examinations have not been published yet, the counsel argued.

Government pleader PG Pramod, who represented the CEE, contended that allowing to opt for NRI seats would cause unnecessary delay in the verification process.

In the order, the court said, “I must say that I cannot find favour with the afore submissions of Sri. P.G. Pramod because, as rightly argued by the learned Senior Counsel – Sri. Kurian George Kannanthanam, even the results of the NEET examinations have not yet been published and candidates are even now allowed to opt for other or additional subjects. When these factors are not controverted, I fail to understand how the verification process can be delayed merely because candidates are allowed to opt for the NRI seats also. This is particularly when, as is admitted, they are allowed to add required courses in the already submitted applications.”

While issuing a directive, the court said, “Resultantly, I order these writ petitions, directing the competent Authorities to keep the Online Portal open for the petitioners and all other candidates, to make options to the NRI Quota, for a period of 10 days from 05.08.2022.”
