Dealing with a woman’s application seeking interim bail for two weeks in a murder case to enable her to get her 8-year-old daughter admitted to a school, the Delhi High Court directed police to ensure her admission and asked the school principal to extend full cooperation. The child’s father is also an accused in the same case.
“Right to Education is a fundamental right guaranteed to every citizen under Article 21-A of the Constitution. A child must not suffer the consequences, on account of their parents having been in judicial custody for a crime which is yet to be adjudicated upon by the court. This court is duty bound to enforce fundamental rights of every citizen, and in this case right to education,” said Justice Swarana Kanta Sharma in an order.
The couple has been in judicial custody since July 11, 2021, in a case related to the murder of an old woman whose body parts were severed and found disposed of in a drain. The trial court had earlier dismissed the woman’s application for interim bail, saying her ground for bail cannot be termed “a compelling circumstance”. Read More

Observing that e-commerce platform Flipkart was permitting third-party unauthorised sellers to use the original manufacturer’s brand name and images for their own listing without consent, the Delhi High Court has said such a feature cannot be allowed to be used or offered to the detriment of the owner of the brand or the person who has created the original product.
“Prima facie, the Flipkart platform is permitting other third-party sellers to ‘latch on’ to the best sellers in one particular segment of products, resulting in various third-party sellers misusing the plaintiff’s brand/mark,” said Justice Prathiba M Singh in an interim order, adding that such sellers can make similar products and sell them as original.
The court made the observations while passing the order in a suit filed by Akash Aggarwal, who sells women’s clothing on various retail e-commerce platforms including Flipkart, to restrain the shopping website from allowing any person or party to portray itself as ‘more sellers’ of goods offered by him. The Delhi High Court has said that an e-commerce platform permitting a third-party seller to “latch on” to the name or mark and product listings of another seller on its platform is “nothing but riding piggyback” and cannot be allowed.
Justice Prathiba M Singh said that “latching on” is a mode of encashing upon the reputation of another entity and the consent and authorisation of the brand owner as well as the listing owner would be required before such conduct is permitted.
The court's observations were made on a lawsuit by an online clothes seller against an e-commerce platform. The plaintiff alleged that the defendant's platform allowed third-party sellers to “latch on” to its product listings. (PTI)

Hearing a petition alleging that due to the lack of a ration card, a 31-year-old woman, who is suffering from aplastic anaemia, is not able to avail of financial assistance under the Rashtriya Arogya Nidhi (RAN) scheme for her treatment, the Delhi High Court Friday said that such a requirement defeats the scheme itself, and asked the Centre to respond to the plea.
“If you want to find out their family details, proof of residence, there are many other documents also. Why would be it imperative for her to have a ration card especially when the issuing authority has not given her one? In the absence of a ration card, she will not get insurance coverage. It defeats the scheme itself,” said Justice Yashwant Varma, during the hearing of a petition seeking direction to AIIMS for accepting the patient’s application for a grant of aid to enable her to get the requisite treatment.
