Goa doctor accused of intimidating cop offers Rs 50k donation for police welfare

PANAJI: A medical doctor against whom an FIR was filed for criminal intimidation of a police personnel offered to donate 25 raincoats and 25 umbrellas of good quality for use by police personnel and their family as well as Rs 50,000 to the Goa police welfare society.
The doctor made the offer before the high court of Bombay at Goa while seeking quashing of the FIR filed against him.
The FIR was filed after the police sub inspector (PSI) on nakabandi duty at Dolphin Circle, Calangute, on March 27, 2020, during the all-India lockdown, stopped the Mercedes Benz being driven by the petitioner, who in turn allegedly threatened him.
The high court quashed the FIR.
The petitioner represented by counsel Vibhav Amonkar tendered an apology for the misunderstanding and offered to transfer the funds and provide the raincoats and umbrellas within one week.
The high court on perusal of the FIR and complaint of the PSI stated that there is absolutely nothing to show that the petitioner either assaulted the PSI or used criminal force to prevent the him from discharging his official duty or that he had threatened the complainant with injury to his person, reputation or property.
The court stated that a threat must be with intention to cause alarm to the complainant to cause that person to do or omit to do any work. “Mere expression of any words without any intention to cause alarm would not be sufficient to bring in the application of this section,” the court stated.
Therefore, prima facie, no offence is made out against the petitioner herein under Section 506 of the Indian Penal Code, the high court stated.
The HC stated that the petitioner’s apology and donations have no nexus with its quashing of the FIR at Calangute police station.
