GURUGRAM: A man who stole a bag containing a cellphone and Rs 1,200 cash in 2016 and spent three years in jail was set free by a district court.
Bhim was asked to pay a Rs 50 fine by the court, but he pleaded inability to do so. The court considered the time Bhim spent in jail as punishment and ordered his release.
A resident of Nangloi in New Delhi, Bhim had stolen a cloth bag containing a phone and the cash from one Uma Dutt Satti on August 9, 2016. A case was registered at Sector 10 police station and Bhim was arrested on August 13 that year, He, however, got bail on September 22.
In its chargesheet, police booked Bhim under sections 380 (theft in house) and 411 (dishonestly receiving stolen property) of the IPC. He was arrested again in February 2020 and sought a trial. The maximum punishment under Section 380 is seven years in jail.
Public prosecutor Krishan said Bhim’s confessional statement was recorded. It was accepted by the court of judicial magistrate (first class) Mansi Guar on July 21 and the man was found guilty under sections 380 and 411 of the IPC.
Bhim was given a lawyer through the legal aid services as he could not afford one. Abhimanyu, who represented Bhim, said he was poor a first-time offender. Bhim, however, pleaded inability to pay the fine and appealed to the court that his custody be extended. “The convict be released forthwith, if not required in any other case,” the court said.
