GURUGRAM: The Haryana Real Estate Regulatory Authority (HRera) on Thursday ordered 23 builders, including Ansal Housing, Raheja Developers, M3M, CHD, Vatika, Anant Raj, Orris, ILD among others, to refund Rs 50 crore to 63 homebuyers for delayed handover of their flats.
While Raheja Developers, according to the order, will have to refund nearly Rs 12 crore to 11 homebuyers, Ansal Housing will have to pay Rs 4 crore to nine buyers.
The regulator directed the builders to refund the money within 90 days without fail along with an interest at the rate of 9.7%. The Rera said the developers failed to give possession of apartments or plots within the stipulated time.
The 63 homebuyers had filed a petition seeking refund and compensation after the developers failed to give possession of their homes on time. They had moved Rera demanding the amount they had paid to the builders.
Rera chairman KK Khandelwal said, “The authority has ordered builders to refund deposited amount to homebuyers after hearing both builders and allottees. We found the realtors have failed to deliver units as per the builder-buyer agreements. The builders should not take homebuyers for granted.”
Only in July, nearly 300 pleas were listed before the authority for adjudication. In the 63 cases, the authority adjudicated the matter allowing refund with an interest at the rate of 9.7%.
VK Goyal, member, Rera, said, “The authority has directed the respondent builders to follow the order. In case they don’t, the complainants can approach the adjudicating authority for execution of orders.”
“The complainant wanted the authority to direct respondent builders to refund their deposited amount with interest from the respective dates of deposit till the date of refund,” reads an order, while adjudicating the matter of a complainant — Ritu Gupta — who moved the regulators against Raheja Developers on July 12.
Further, the authority allowed the refund of approximately Rs 9.5 crore adjudicating complaints of 20 homebuyers of Orris Infrastructure Pvt Ltd, International Land Developers Pvt Ltd, Pareena Infrastructure PVt Ltd, M3M India Pvt Ltd, Martial Buildcon PVt Ltd, Spaze Tower Pvt Ltd, Imperia Structures Ltd and ALM Infotech City Pvt Ltd.
