Delhi HC dismisses petition seeking postponement of NEET-UG exam: ‘Candidates can’t approach court at last hour’

Dismissing the petition seeking postponement of the NEET-UG 2022 examination which is scheduled to be held on July 21, the Delhi High Court on Thursday said that such type of petitions should be discouraged and candidates cannot approach the courts at the last hour.

Terming the submissions made before it vague, Justice Sanjeev Narula said that there is no merit in the petition and it is totally misconceived. “Just because the petitioners are students, the court is not going to be harsh,” said the court, adding that it would have imposed a fine had the case been otherwise.

A petition seeking postponement of the examination was filed before the court on Wednesday. Seeking a rescheduling of the examination, the petition cited floods in certain parts of the country, the reported suicides by the aspirants and less time gap between different national examinations like NEET, JEE and Common University Entrance Test as grounds to seek the deferment.

The court at the outset said that notice for the examination was issued in April and asked how 15 candidates can decide whether the exam should be postponed or not. When the counsel representing the petitioners argued that many people have died in floods, the court observed that India is a vast country and something keeps happening during monsoon season.

In response a submission that 17 students have committed suicide, the court questioned how that can be related to the examinations schedule. “We don’t know the real cause of suicides,” said the court.

The counsel representing the National Testing Agency and National Medical Commission argued that even a day’s delay will “create havoc” and told the court that it has now become an “industry” to approach the court for postponement of exams every year.
