Indore: High Court orders status quo on pleas by 2 self-financing teachers

Indore (Madhya Pradesh): Self-financing teachers have got a ray of hope as Indore bench of Madhya Pradesh High Court has ordered for status quo on petitions by two teachers aggrieved by a DHE letter pertaining to getting benefit under career advancement scheme (CAS).

Last month, DHE had informed Devi Ahilya Vishwavidyalaya (DAVV) that teachers appointed under self-financing schemes were not entitled to get benefits of CAS.

Noting that the promotions done previously under CAS were not as per rules, DHE had asked DAVV to take necessary action.

The reply had come as a blow to self-financing teachers who had received promotions and those awaiting promotions under CAS.

Some teachers, including Pooja Jain and Anshu Bhati, had moved court challenging the DHE’s missive.

On the petitions by Jain and Bhati, Justice Subodh Abhyankar ordered for issuing notices to the state government, chancellor, UGC, DAVV and AICTE.

“Till the next date of hearing, it is directed that the status quo be maintained regarding maintaining the terms and conditions of the services of the petitioner,” the judge ruled.

How issue cropped up

After interviews of some self-financing teachers under CAS, the sealed envelopes were put before the executive council of DAVV but they were not opened as some members claimed that CAS benefit is not for self-financing teaching staff.

In 2018, DAVV had sent a letter to DHE seeking guidance over the matter.

After four years, DHE replied, “According to the university’s proposal and the exit policy approved by the Finance Department, DHE through a letter dated 19-5-2006 had given permission for filling of 245 academic posts (professor, reader and lecturer) under self-financing scheme.

“The permission was subject to 17 conditions. No amendment has been made in the letter/instruction issued by the department so far,” the DHE said, stating that CAS benefits can’t be given to self-financing teachers.
