Gauhati HC issues notices to Bengal chief secy, top cop

Guwahati: Gauhati High Court has issued notices to West Bengal chief secretary and Kolkata Police commissioner, seeking their reply on a complaint by Assam Police that neighbouring state’s police have not cooperated in execution of a non-bailable warrant against a person of its state accused of objectionable remarks against Swargadeo Sukapha, the founder of the Ahom dynasty.
On Tuesday, during the hearing of the writ petition filed by advocate Banahsree Gogoi, senior government advocate D Nath submitted that during the pendency of this writ petition, the FIR has been registered and NBWA has also been issued against the named accused person, who is a resident of West Bengal.
The court noted Nath’s submission that despite repeated efforts, the NBWA could not be executed by the police “due to lack of cooperation from the West Bengal Police.”
Justice Suman Shyam in his order stated, “Today, after hearing the submissions of learned counsel for the State of Assam to the effect that due to non-cooperation of the State police of West Bengal, the NBWA could not be executed, this court is left with no option but to issue notice” to WB chief secretary and Kolkata police commissioner, returnable in six weeks.
The case was registered by Crime Branch Police Station in 2020 under Section 153(A) of the IPC read with Section 67 of the IT Act.
