Allahabad HC upholds death to man who killed wife, 4 daughters

LUCKNOW: A Lucknow bench of Allahabad HC has confirmed death penalty to a man who killed his wife and four minor daughters in 2011, suspecting that his spouse was in an illicit relation.
Dismissing the appeal of the accused, a bench of Justices Ramesh Sinha and BR Singh observed, “The motive is proved by the prosecution; the prosecution witnesses fully supported the case; the medical evidence also corroborated the disclosure statement made by the appellant Deen Dayal Tiwari before police; and he was arrested on spot by police with the weapon of assault.”
Earlier, government advocate Vimal Srivastava said that the case falls in the ‘rarest of rare’ category and justified award of death penalty. The bench observed, “We are also of the view that the appellant is a menace to the society and there is no chance of his rehabilitation or reformation and no leniency in imposing punishment is called for.”
One Dinanath Tiwari had lodged an FIR on November 12, 2011, at Pura Kalandar police station in Ayodhya, alleging that he heard screams of his brother Deen Dayal Tiwari’s wife and daughters and rushed with his wife Suneeta alias Anita. They went to the house and asked the appellant to open the door, but he refused. When they threatened to break the door, he came out holding an axe smeared with blood and threatened to attack them. He said he had killed his wife and four daughters and would kill them also.
The villagers overpowered Tiwari and went inside to find he had killed his wife and four daughters. Earlier, additional sessions judge, court No. 5, Ayodhya, had convicted Tiwari under Section 302 of IPC and awarded death sentence on January 30, 2014.
In fact, the appellant had confessed to an independent witness that he had killed his wife Siyallali (36) as she had illicit relations with someone in the village and when his daughters Mani (11), Riya (8), Guddan (6) and Mahima (4) tried to save her, he killed them also. Tiwari had filed appeal against the conviction and sentence, while the additional session court had sent the case to the high court for confirmation of death penalty.
The appellant pleaded not guilty saying his brother Dinanath had killed his family in the greed of property and falsely implicated him. The HC dismissed the appeal and confirmed the sentence. It said the execution of the death sentence shall stand postponed until the period for appeal in the Supreme Court expires, and until such appeal is disposed of.
