Vadodara: Eleven months after they were arrested for alleged gan grape of a 19-year-old girl, the court on Monday acquitted two men of all the charges.

Popat Patel said that as per the available evidence there is nothing against the accused and the prosecution has failed to prove the charges.
The accused, Dishant Kahar and
Nazeem Mirza, were acquitted of charges of rape, abetment to suicide and the Prohibition Act. “The court said that there is no direct evidence against the accused and the electronic and scientific evidence was inconclusive. The girl’s dying declaration didn’t name the two and some material witnesses were also not examined by the prosecution,” said advocate

Kumar Singh and Kamlesh Gangwani. The defence lawyers argued that the girl had kept a party at her room and invited her friends along with Dishant and Nazeem.
The defence said that liquor was consumed willingly by the girl and there was no force on anyone present there.
“There were a lot of contradictions in the statements of the witnesses. The girl was also undergoing treatment for headache and she used to miss her mother who had passed away,” Godia added. The court acquitted the accused on a bail bond of Rs 5,000.
The incident had occurred in June last year when the girl had committed suicide at her home in the city. After her death, the police began investigations and it came to light that she had organized party with her friends at her room two days before the suicide.
The girl’s boyfriend had arrived during the party and seen Dishant and Nazeem there.
The duo left the room and the boyfriend took her to her father’s house. The next day, the girl’s father had called the accused to his home and made them delete all the photographs they had of her in their mobile phone along with her chats.
The girl committed suicide a day later and left a note behind wherein she wrote that “something terrible” had happened to her. But she hadn’t named anyone. But the police arrested Dishant and Nazeem for allegedly raping the girl, after taking statements from the witnesses.
