Gurgaon: The Real Estate Regulatory Authority (Rera) in Haryana has ordered that arrest warrants be issued against the directors of Ansal Housing Limited for not complying with an earlier order to refund homebuyers Rs 5 crore.
Rera had asked the directors of Ansal Housing to pay Rs 5 crore along with an interest of 9.3% to one Rajeev Sharma and four others, who had complained against the developer. The regulatory authority had invoked Section 31 of The Real Estate (Regulation and Development) Act, 2016.
Sharma and the other complainants were buyers of flats in Ansal Heights in Sector 86. Launched in 2010, the project with 750 units on 10.5 acres was supposed to have been completed by 2014.
Following the earlier order, Ansal neither refunded the amount nor filed any appeal against the directive despite repeated reminders. The authority has now ordered that arrest warrants be issued against the directors — Kushagar Ansal, Karun Ansal, SL Kapur and Ashok Khanna. It also issued summons to the manager of the company.
Rera chief KK Khandelwal described the developer’s failure to deliver the flats on time or refund the homebuyers as a “major concern”. “To reiterate the probity and responsibility of obeying and respecting the rules framed for better and smooth functioning of the real estate sector, stringent action has been taken against them,” he added.
Rera had earlier ordered that the bank account of the developer be attached, but was informed that the account did not have any balance. The developer was then asked to furnish details of the assets. Told about the latest order, a spokesperson for the company said they were in touch with the complainants to resolve the issues.
