Guwahati: Gauhati High Court has opined that the custody of seized articles, including vehicles and wild animals, can be granted during inquiry or trial but not at the stage of investigation. The court of Justice Rumi Kumari Phukan issued this direction on Friday while dealing a criminal review petition filed by one Rafikul Islam challenging a lower court order. “Now, seized betel nut, vehicles and wild animals cannot be taken in custody at the stage of investigation,” said additional advocate general Parangam Goswami. Islam’s truck was confiscated by the excise department last year for carrying illicit liquor. Police had taken the vehicle in custody. Later, Islam prayed before the lower court to release his seized vehicle, which the court refused. Following this, Islam moved Gauhati High Court seeking a direction.
