HC directs KEA to permit OCI students to appear for examination and counseling

A vacation division bench headed by Justice R Devdas passed this order while citing the February 8,2022 interim order passed by the Supreme court in Dr Radhika Thappetta vs Union of India case.
In their order, the bench has also pointed out that the top court had permitted the petitioners therein( OCI students) to appear in the counselling in general category,on par with Indian citizens to pursue their respective courses.
Though the counsel for KEA argued that the benefit extended by the Supreme court was limited to academic year 2021-22 only, the the bench noted that since the challenge to March 4,2021 notification issued by the central government has not been decided by the Supreme court, the benefit of top court's February 8,2022 Interim order has to be extended to petitioners before the court for the academic year 2022-23 also .
The court is hearing petitions filed by Srishti Sosale and other OCI students .They are aspiring to study Engineering and other professional courses in Karnataka. Petitioners claimed that March 4,2021 notification issued by the central government makes them eligible for admission only against any NRI seat or any supernumerary seat, seriously affecting their educational rights.
