Majithia’s interim bail extended till Jan 24

The Punjab Police had booked the 46-year-old Majithia under the Narcotic Drugs and Psychotropic Substances (NDPS) Act last month over his alleged involvement in a drugs case.

The Punjab and Haryana High Court on Tuesday extended the interim protection from arrest given to the SAD leader Bikram Singh Majithia in the alleged NDPS case till the next date of hearing of case scheduled for January 24.

The matter of anticipatory bail of Majithia came up for hearing before the bench of Justice Lisa Gill, wherein Advocate Arshdeep Singh Cheema, counsel for petitioner contended that Senior Advocate R S Cheema, has contracted COVID-19 and thus sought for an adjournment on this ground.

Appearing on behalf of Punjab, Senior Advocate P Chidambaram, while not opposing the adjournment on this ground, submitted that the petitioner having joined investigation has not extended full cooperation during investigation.

Justice Gill hearing the plea for adjournment by petitioner counsel said, “Though, I was not inclined to adjourn the matter, however, keeping in view the circumstance as above and with consent of learned counsel for the parties, adjourned to January 24, 2022 for final arguments.”

Though the Bench ordered that the interim order shall continue till the next date of hearing, however made it clear that in case arguments are not addressed on the next date of hearing, interim bail afforded to the petitioner shall automatically stand vacated.

Justice Gill further added that the petitioner will, in the meantime, continue to join investigation as and when required and in terms of conditions contained in order dated January 10, 2022 and extend full cooperation to the investigating agency.
