LUCKNOW: The Lucknow Bench of
Allahabad High Court has asked the
Greater Noida Industrial Development Authority (GNIDA) as to what provision it has made to ensure
water supply to industries established in its area.
It also asked the GNIDA how the industries have been obtaining water in the entire
industrial area. It fixed November 23 as the next date of hearing in the matter.
A bench of
Justice Vivek Chaudhary passed the order on a writ petition moved
Supertech Precast Technologies Private Limited. The petitioner has challenged the recovery order issued against the petitioner for failing to deposit the rent against the lease of land executed in its favour to run the industry in the GNIDA area.
It was submitted that the petitioner could not run the industry because it was not being supplied water for the industrial use. “In such conditions, it is wholly arbitrary to coerce the petitioner company to pay the rent against the leased land,” argued the petitioner’s counsel Abhisekh Khare.
The petitioner further pleaded that it also represented to the state government about its grievance but it shrugged off saying the authority provides STP water and the petitioner should also avail water from it after paying the charges.
Considering the matter, the bench was prima-facie of the view if water was not supplied to the industries for running the industry, the purpose of taking land on lease from the GNIDA would frustrate.
