German court must clarify whether 5G auction in 2019 violated procedural norms

The German Federal Administrative Court said that the Administrative Court in Cologne must clarify whether the Federal Network Agency (BNetzA) made procedural mistakes when allocating 5G frequencies in the 2 GHz and 3.6 GHz bands in 2019. The Cologne court had dismissed complaints from a mobile network operator and a service provider. The federal court partially overturned that judgment and referred the matter back to the administrative court. The mobile network operator's complaint was rejected because it was aimed at partially repealing a BNetzA decision.
