Big setback for Kangana Ranaut, court rejects actress’ plea seeking transfer of Javed Akhtar defamation case

A Mumbai court recently rejected actress Kangana Ranaut’s plea seeking transfer of lyricist Javed Akhtar's complaint to a different court. While denying the transfer of case, the Additional Chief Metropolitan Magistrate said, 'It is a settled position of law that the proceeding cannot be transferred from one court to another on mere apprehension.' The court also stated that it went through all the details brought forward by the record and found that 'Metropolitan Magistrate has not acted against the applicant/accused and neither had any bias towards her.' Earlier, while filing the transfer plea last month, Ranaut had stated that she wants the case to be reallocated before another judge as she has 'lost faith' in it. Now, the court after looking into the matter, observed that Kangana had 'failed to make out a positive, concrete case to show that her apprehension is reasonable. If on the basis of false allegations, the matter is transferred, it will affect the morale of the presiding officer. There are no grounds made out for transfer of the case to any other court.' On the other hand, Javed Akhtar's lawyer while opposing Ranaut’s plea stated that in February the Andheri court issued the process against her observing that the defamation case was made out. Akhtar's lawyer also alleged that Kangana delayed the case 'causing further harassment' to the veteran lyricist. The matter relates to interviews given by Kangana Ranaut against Javed Akhtar after the demise of actor Sushant Singh Rajput in the year 2020. Apart from this, the 'Thalaivii' actress recently took to her Instagram account to share a post after hearing about Alec Baldwin's prop-gun incident. The accident happened on the sets of 'Rust' where a bullet fired by Alec killed cinematographer Halyna Hutchins and injured director Joel Souza. In her post Kangana recalled her near death experience and wrote, 'This is so horrible!!! Note for all the people working in films dealing with various stunts, weapons and explosives... Your mistakes can cause someone their life... Tragic.'
