Tripura HC Refuses to Stay Police Probe Against TMC Leader Abhishek Banerjee, Five Others

According to the police, the 14 TMC members were nabbed for venturing out after the imposition of night curfew at 7 pm, in violation of the COVID-19 restrictions.

The Tripura High Court stayed filing of the final report or a charge-sheet without leave of court in Abhishek Banerjee FIR case.

TMC leader Abhishek Banerjee and others moved the HC to quash an FIR registered against them in Khowai Thana.

The court has asked the police to submit all records and the matter has been fixed for hearing after two weeks.

Sanjay Basu, the advocate of Abhishek Banerjee and other leaders, said: “Any filing of charge-sheet or final report has been stated by the honourable court. The court also queried that why the bail of 14 other leaders could not be given in the police station? The court has further asked for all records in both cases. We are happy and we are looking forward to the next hearing."

The case against Abhishek Banerjee and others is contradictory to the own narrative of the State, the court observed.

This case was filed by the Khowai Thana on a suo moto basis. It all started when TMC claimed that their workers were beaten up in Ambassa and were arrested the next day. Abhishek Banerjee and other leaders went to the police station and asked the police officer that why only TMC workers were arrested and not BJP workers who were sloganeering outside.

The 14 accused had to be produced in the Court and bail was granted to them.

On the very next day, an FIR was lodged against Abhishek Banerjee and other leaders such as Kunal Ghosh, Bratyo Basu and MP Dola Sen and others.
