President Biden will nominate acting Solicitor General Elizabeth Prelogar to the job on a permanent basis, AP first reported on Tuesday.
Why it matters: Prelogar would be the second woman to ever be in charge of representing the U.S. during litigation before the Supreme court, if confirmed by the Senate.

Background: Prelogar is a Harvard Law graduate and served as a clerk to Attorney General Merrick Garland during when he was a judge on the D.C. Circuit Court. She has been a clerk for Justices Ruth Bader Ginsburg and Elena Kagan — the only woman to have been solicitor general.
Prelogar also served as an attorney in the solicitor general's office for five years. She spent some of that time in a dual role on the staff of former Special Counsel Robert Mueller during the investigation into alleged ties between the Trump campaign and Russia.
