Judge Denies Request to Move Britney Spears' Conservatorship Hearing From September

A judge in Los Angeles, California denied a request to move Britney Spears' conservatorship hearing from September to August.

On Monday, Judge Brenda Penny denied a request made by Spears' attorney, Mathew Rosengart, to move a hearing on the star's conservatorship from September 29 to August 23. According to court documents obtained by CNN, Judge Penny did not provide a reason for her ruling.

The petition was denied without prejudice which means Rosengart can re-file again in the near future.

The petition filed by Rosengart last week sought to remove Spears' father, James Spears, as conservator of her estate, as early as possible. The ruling by Judge Penny on Monday indicates that Spears' father will remain the conservator of his daughter's estate for time time being.

In the petition calling for an earlier hearing date, Rosengart wrote "Every day that passes is another day of avoidable harm and prejudice to Ms. Spears and the Estate."

Rosengart continued in the petition, "Ms. Spears's emotional health and well-being must be, and are, the paramount concern. Further, all interested parties forcefully agree that Mr. Spears's continued presence as Conservator of the Estate is contrary to Ms. Spears's best interests, health, and well-being, and that his prompt removal—or, at the very least, his immediate suspension—is 'critical' at this juncture."

According to court documents obtained by the New York Times, Vivian Lee Thoreen, a lawyer for Spears' father, previously agreed to move the hearing date to August 23, but denied the notion that Spears should be removed as conservator as soon as possible.

The Times reported Thoreen wrote in a petition that Spears' "dutifully and faithfully served as the conservator of his daughter's estate without any blemishes on his record."

"Mr. Spears's sole motivation has been his unconditional love for his daughter and a fierce desire to protect her from those trying to take advantage of her," Thoreen wrote in court documents, according to the Times.

Since 2008, the 39-year-old Spears has lived under a court-approved conservatorship, but she recently has criticized her father's handling and said last month she believes her father should be charged with "conservatorship abuse."

While testifying before a court in June, Spears first spoke about her father's conservatorship, saying "I've been in denial. I've been in shock. I am traumatized."

"I shouldn't be in a conservatorship if I can work. The laws need to change," she said during the testimony. "I truly believe this conservatorship is abusive. I don't feel like I can live a full life."

Rosengart told Newsweek he had no further comment on Judge Penny's ruling on Monday.
