The heartless ex-NYPD cop who allegedly left his 8-year-old son to die in a freezing Long Island garage lost a bid to toss out key video evidence at his upcoming murder trial.
A judge has ruled a Ring camera video from inside the house, which prosecutors say proves the parents abused the kids, can be used during the trial, PIX11 reports.
Former cop Michael Valva and his former fiancée were both indicted in Suffolk County in the death of the boy, Thomas.
The couple is charged with second-degree murder for allegedly forcing him to sleep out in their freezing garage, causing the boy to die of hypothermia in January 2020.
Thomas and his 10-year-old brother, both on the autism spectrum, were both locked in the garage, prosecutors said.
Valva, 40, and Angela Pollina, 42, allegedly did nothing to help the autistic boy and acted with “depraved indifference to human life.”
