Amul wins trademark case in Canada

After winning the trademark violation case, Amul will also be awarded damages aggregating to Canadian dollar (CAD) 32,733.

India's dairy giant, Amul has won its trademark violation case in Canada as the Intellectual Property Appellate Board of Canada recently approved the company its trademark status. That said, 'Amul-The Taste of India’ has been recognized by Canada.

After winning the trademark violation case, Amul will also be awarded damages aggregating to Canadian dollar (CAD) 32,733.

In the verdict, the Federal Court stated that the defendants had infringed the copyright of Amul.

The Court further issued the order of permanently restraining the defendants from infringing the trademark and copyright of ‘Amul’ and 'Amul-The Taste of India'.

This would be the first case that Amul had filed a case against any company on foreign soil.

The case involved that last year in January, Amul found out that Amul Canada and four others have copied their trademark 'Amul' and also the logo 'Amul-The Taste of India'. It was also noted that a fake profile on social media platform LinkedIn was created using the trademark 'Amul'.

Thereby, the Kaira District Cooperative Milk Producers Union Limited which is popularly known as Amul Dairy and the Gujarat Co-operative Milk Marketing Federation (GCMMF) which markets the brand Amul - had filed a case against Amul Canada and four others before the Federal Court of Canada.
