Submitter Manisha Malik requested the Supreme Court to further issue an India visa for her YouTuber husband, whose real name is Karl Edward Rice, enabling Rice to visit India under the valid conditions of an Indian Visa.
In her petition filed by lawyer Fuzail Ahmad Ayyubi, Malik appealed to the Delhi High Court to seek records for the cancellation of Visa and the unilateral blacklist of her husband by the respondents.
Attorney Ayyubi told the court in the petition that the petitioner Malik preferred that the immediate petition contest the arbitrary and unreasonable blacklist of Rice, ‘who had not been able to return from New Zealand to India since October 10, 2020.
” The submitter is an Indian citizen and has been with Karl Edward Rice, a New Zealand citizen, since 2014, and was married to him in 2019. Since their marriage, the submitter and Rice have been living together peacefully in New Delhi. The submitter and her husband are YouTube vloggers and therefore visited most of India to capture its beauty and thus contribute to the promotion of tourism in India, ”reads the petition.
“The applicant, on the grounds of refusal of a visa to her husband who was arbitrarily blacklisted by the Respondents, is deprived of living with her husband and thereby her fundamental right to life and dignity, as guaranteed under section 21. , be violated, “reads the plea.
It also said that Rice has the dual nationality of New Zealand and the Netherlands and has been visiting India since 2013, strictly complying with the laws of the country and the Visa conditions.
“Throughout the entire period since 2013, while the submitter’s husband obtained an Indian visa on various occasions, there has not been a single allegation against the submitter’s husband,” the lawyer said.
“After the submitter’s marriage to Rice, the submitter’s husband was granted an X-2 visa (intended for the spouse / children of an Indian citizen) with a validity period until May 2024 and one of the conditions in the said Visa was that the submitter’s husband would leave India every 180 days or the relevant foreign regional registration office would have to be intimate, ”the lawyer added.
Advocate Ayyubi further argued that he met the condition of leaving the country while the husband of the petitioner left India on 10 October 2020, was not yet able to return to India because the respondent by the respondents refused to issue an Indian visa.
“While the applicant ran from pillar to post and no reasons were communicated to Karl Edward Rice or to the applicant himself on the basis of which her husband’s request for a visa was issued, the applicant’s husband is only orally informed that he has been blacklisted and therefore may not enter India. The petitioner and her husband, divorced on the basis of this sudden and arbitrary blacklist by the respondents, also have no way of indicating the nature or period of such blacklist, ” the petition further added.
Earlier today, sources in the Interior Ministry said that the vlogger was found to be doing business activities on a tourist visa, which violates the terms and conditions of his visa and that it may not enter India for a year and his visa was also canceled by the government.
Rice claimed on Friday that the Indian government canceled his visa last year without giving him a reason why he was blacklisted after leaving India to travel to Dubai and Pakistan.
The YouTuber whose channel on the social media platform had more than 1.79 million subscribers, posted a video on July 9 titled ‘Why I Have Not Seen My Wife in 269 Days #Blacklist’.
