Assault accuser wants default judgment against ex-Nets’ player Darius Morris

A woman who accused former Brooklyn Nets and LA Lakers player Darius Morris of assault is now asking a court to enter a default judgment against him for not responding to her case, Manhattan court papers show.

Kristen Summer had filed suit against the 30-year-old ex-NBA player in Manhattan Supreme Court in April alleging “assault and battery, intentional infliction of emotional distress, and gender motivated violence,” according to court documents.

“To date defaulting defendants have not submitted their answer to [her] complaint,” Summer’s lawyer, Alex Cabeceiras, wrote in new papers Thursday.

Summer is seeking a default judgment against Morris as well as a court date to determine damages against him, the documents say.

Morris was arrested in April 2020 on charges of assault, harassment and obstruction of breathing or blood circulation involving a woman who wasn’t identified at the time. He allegedly repeatedly kicked and hit her and put his hand over her mouth, according to a criminal complaint.

Morris’s criminal lawyer, Stacey Richman, has now confirmed to The Post that Summer was the accuser in that case.

Morris also was separately charged with violating an order of protection against the woman when he showed up in the hallway outside of her apartment a few weeks after the alleged attack. He was released on both criminal cases, which are pending.

Richman told The Post on Friday that she was only alerted to the lawsuit against her client after The Post called her for comment about Summer’s request for a default judgment.

“I don’t think Mr. Morris is aware of this suit, and we will be seeking leave to enter and to properly respond to the allegations,” Richman said.

An ex-girlfriend of Morris named Kristen Evangaline recently came out on Instagram with graphic photos and videos of domestic violence that she claimed Morris committed against her last April, the Florida New Times reported. It was not immediately clear if Kristen Evangaline and Kristen Summer are the same person.
