FPJ Legal: Session court refused bail to prime accused Shree Jogdhankar in Jhanvi Kukreja murder case

A sessions court on Thursday rejected the application of prime accused Shree Jogdhankar, in the Khar murder case of 19-year-old Jhanvi Kukreja, in which he had sought a direction to the police to provide him with CCTV footage of the building where the incident took place. The court said the case was before a magistrate’s court and he had to approach that court for it.

Jogdhankar, through his advocate, also wanted permission to play the videos before the court before it decided on its bail application. He also sought copies of all other footages and photographs submitted by the police with the charge sheet.

The court, while rejecting the plea, said in its order, that the application cannot be considered while deciding his bail plea as the case is not pending before the sessions court. It is yet to be committed to a sessions court from the magistrate court, it noted and said that Jogdhankar is free to raise his grievances of non-supply of documents before the magistrate where the concerned chargesheet was filed.

Additional Sessions Judge MM Umar also stated that it is pertinent to note that Joghankar’s advocate has completed his arguments on his bail plea and the prosecutor too had partly argued it and thereafter the present plea was filed on Thursday. The bail plea cannot be adjourned for the purpose of furnishing copies of such records, particularly when the advocate for the applicant has completed his lengthy arguments, the court added.

22-year-old Joghankar and 19-year-old Diya Padalkar are facing charges of murdering their common friend Kukreja on New Year’s Eve last year.
