Someone living in glass houses should not throw stones at others: SC to Ex-Mumbai CP

New Delhi: The High Court on Friday expressed shock and refused to deliver a plea from former Mumbai Police Commissioner Param Bir Singh and demanded that all investigations be transferred to him outside Maharashtra and also that all investigations by the state police into an independent agency must be transferred.

A bank with Judge Hemant Gupta and V. Ramasubramanian told Singh’s council: ‘The person living in a closet should not throw stones at others. ‘

The bank told senior lawyer Mahesh Jethmalani, who represents Singh, ‘You have been in the police force for 30 years. You can not say now that you want your inquiries outside the state. You can not doubt your own power. ”

Singh claimed a witch-hunt after accusing then-Interior Minister Anil Deshmukh of using corrupt practices in the post or transfer to the police, in addition to extorting 100 million a month from various agencies.

Jethmalani argued that cases were being registered against his client and that he was being punished for writing the letter to the Maharashtra prime minister in connection with the former interior minister.

The bank replied: ‘It is shocking that you have served in the same system for thirty years and now you are suddenly making allegations against everyone.’

The court pointed out that Singh is a cadre officer of Maharashtra. Jethmalani pointed to political pressure on officials investigating cases against Singh. However, the Supreme Court decided to dismiss the petition.

Senior lawyer Puneet Bali, representing Singh, asked the court not to dismiss the petition and allow his client to pursue other remedies. After hearing arguments, Singh allowed the petition.

In a written petition, Singh claims that the state government investigating officer is threatening him with false cases unless he withdraws the charge against Deshmukh. Singh has asked the Supreme Court to transfer all investigations already instituted or intended against him to the CBI, which is currently investigating the charges against Deshmukh.

He alleges that he submitted transcripts to the CBI related to alleged telephone conversations of the investigating officer who threatened him.

“Give a mandamus or any other appropriate written order or instruction that the respondent no. 1, its officials and agencies to: (i) transmit the petition to any other State for all inquiries already ordered for consideration by departmental action. (ii) all the investigations which have already been considered or which have been instituted against the applicant for criminal prosecution, to an independent agency such as respondent no. 2 Central Bureau of Investigation, which is already the related case, or any other investigative agency outside the state of Maharashtra, ”reads the plea of Singh.
