Eskom will know by the end of August if its application to recover R8.4 billion for the 2019/20 financial year is approved by the National Energy Regulator of South Africa.
The regulator on Tuesday published a timeline for the processing of Eskom's Regulatory Clearing Account (RCA) Year 1 application after a request was filed for the clawback on 11 December 2020.
A decision will be taken on 26 August after a series of consultations with the public and other stakeholders.
"Eskom is requesting a total RCA balance of R8.4 billion," Nersa said in a statement.
The RCA is a correction mechanism relating to the multi-year price determination for the power utility. It allows for excess or inadequate returns to be managed.
However, the state-owned power company and the energy regulator have in recent years been locked in legal disputes over price determinations.
Eskom has approached the courts to review and set aside Nersa's approval of a Regulatory Clearing Account balance of R13.271 billion for the 2018/19 financial year. This comes after Nersa in May 2020 approved Eskom's application to recover R13.3 billion as part of its RCA application for the 2018/19 year, which was less than what Eskom had applied for.
Nersa is opposing the court action.
