Over two years after the death of a 31-year-old inmate inside the Arthur Road prison, the NM Joshi Marg police on Thursday registered an offence after Magistrate court's order.

The police registered an offence under Section 304 (culpable homicide not amounting to murder) of the Indian Penal Code (IPC) against an unknown person into the death of Firoj Mohammad Gaus Shaikh who died inside the jail in September 2018.

In his statement to the police, Shaikh's brother Furkan alleges that his brother had been assaulted inside the jail leading to his death.

Shaikh, a resident of Dharavi, was arrested by Bandra Police in an assault case on September 9, 2018 and was sent to Arthur Road Jail. Two days later, he suffered an epilepsy attack and was subsequently admitted to Sir JJ Hospital and a couple of days later he was shifted to hospital inside the jail. On September 24, he died inside the hospital.

The NM Joshi Marg police then registered an accidental death report, since Shaikh had died inside the prison, a magistrate enquiry had been ordered. In the post mortem report, the doctor had found several injuries on the Shaikh's body and on his head. The doctor also mentioned the fractured jaw and reported that Shaikh had died under unnatural circumstances.

Following the enquiry, the Magistrate court ordered the N M Joshi Marg police to register an offence and investigate his death.

The police have taken the statement of Shaikh's brother Furkan, who stated that his brother had died after being assaulted inside the jail. We have registered an offence against an unknown person and investigation is underway, said a police officer.
