Complainant’s plea
A former inspector of the Chandigarh Police, Gurnam Singh, has alleged that the hotel staff attacked him and his family members but the police did not register the case on their complaints. However, the police filed the case against them on a complaint of the hotel staff.
The court directed that the CD of the footage be prepared as per the provisions of Section 65-B of the Indian Evidence Act.
Renu Goyal, Judicial Magistrate (First Class), has passed the order while allowing the application of a former inspector of the Chandigarh Police, Gurnam Singh.
Gurnam filed a criminal complaint in the court through advocate Munish Dewan, under section 156 (3), CrPC, for seeking the directions to the police for registration of an FIR against Assistant Sub-Inspector Kabal Singh, hotel staff and others.
Gurnam alleged that the hotel staff attacked him and his family members but the police did not register the case on their complaints. However, the police filed the case against them on a complaint of the hotel staff.
The court says that the status report submitted by the police reveals that they have also mentioned this fact that they have registered an FIR against
the complainant and his relatives on the basis of CCTV footage of the hotel. A pen drive of the incident played in the court contained the CCTV footage only of a few minutes. The counsel for the complainant argued that it was not the complete footage and the police were again shielding the opposite party, who are influential persons.
