Vosloosrus security guard allegedly used live ammo to kill man during lockdown, court hears

The South Gauteng High Court in Johannesburg heard on Thursday how a security guard allegedly shot and killed Sibusiso Amos with live ammunition loaded in a shotgun belonging to the state.

Amos was shot at close range during the enforcement of lockdown regulations on 29 March 2020.

He was at his Vosloorus home when he was accosted by security guard Siphiwe Ndlovu and Ekurhuleni Metro Police Department (EMPD) members.

Ndlovu was employed by the Magma security company at the time.

He allegedly used an EMPD shotgun loaded with SSG ammunition to shoot Amos at close range.

The weapon belonged to Constable Hezekiah Matyobane of the EMPD who was arrested with Ndlovu, but later acquitted.

On Thursday, the shotgun was brought to the High Court as an exhibit.

Captain Luvuyo Mlindazwe, who is attached to the police's forensic department in Pretoria, told Judge Phanuel Mudau that Amos was shot at close range.

He said investigators told him Ndlovu might have used live ammunition when he allegedly shot Amos.

Mlindazwe added on 30 March 2020, during the reconstruction of the scene, he was told by a witness Ndlovu was standing close to Amos when the shots were fired. 

The shooter was standing about 2m away from the victim. The shooter used deadly ammunition.

He said the shotgun was not loaded with rubber bullets.

"A rubber bullet is not meant to kill, but the live ammunition is deadly and kills. Firing a shotgun is not an easy and quick process for someone who has never used it before. Immediately, when the gun is fired, pellets from live ammunition spread in different directions."

Mlindazwe added the autopsy confirmed Amos was shot at close range with live ammunition.

Some pellets were found stuck in his body.

Ndlovu, who was out on R20 000 bail, will remain in custody after his bail was revoked. 

He allegedly violated his bail conditions and interfered with witnesses.

The case has been postponed to Monday.
