MLAs' disqualifcation case listed for July 5

Imphal, May 07 2021: The Supreme Court has tentatively fixed July 5 as the next date of hearing for the writ petition fled by Congress MLA DD Taisii seeking the disqualifcation of 12 MLAs who were appointed as parliamentary secretaries, for enjoying Ofce of Proft.

The motion hearing of the writ petition (Civil) no.151 of 2021, mentioning the Election Commission of India as respondent, was heard by a bench of Supreme Court comprising Justices L Nageswara Rao and S Ravindra Bhat on Tursday.

During the hearing, the bench accepted the petitioner's application to modify the writ petition and to further include one more respondent.

According to the petition, the case was listed on February 12 and a show cause notice was sent to the respondent via post.

However, no one stepped up to represent the respondent and the show cause notice period lapsed.

Advocate Rajesh Mahale, who is representing the petitioner, fled an application on March 17 to modify the writ petition and to also include the secretary to the Governor of Manipur, Bobby Waikhom in the list of respondents.

The apex court discussed the application during a hearing held on April 15 and gave its approval for further hearing of the case.

Mention may be made here that in addition to writ petition (Civil) no 151 of 2021 fled by MLA Taisii, a similar SLP (no 2001-2005/2021) was fled by the State of Manipur with regard to the case with MLA Okram Surjakumar as respondent.

Another SLP (Civil) 2386-2390/2021 was fled to the Supreme Court by Khurai AC MLA Leishangthem Susindro Meitei (Yaima) mentioning MLA Okram Surjakumar as respondent.
