Babysana's dad urges further probe

Imphal, April 29 2021: Father of N Babysana has filed an application before the Chief Judicial Magistrate Imphal West to allow further investigation into the controversial case of 2019 .

Ningthoujam Tomchou filed the application yesterday against the Central Bureau of Investigation (CBI) and five other accused persons asking the CJM to allow further investigation and conduct a DNA profiling of the "blood stain (AB) found in the middle finger of Babysana".

The five accused named in the application include Nongmaithem Jinnty of Yaiskul Moirangkhom, Kamei Ileen of Langthabal Chingthak, Pheroijam Robinson of Canchipur, Pheiroijam ongbi Longjam Ningol Landhoni and Pheiroijam Ningol Karam Ongbi Romita of Kwakeithel Thiyam Leikai.

The application mentions that N Babysana was found dead at a boarding inside the campus of Standard Robarth School, Canchipur, "illegally" run by Pheiroijam Landhoni, against whom Singjamei police had registered a case.

The police had established that Pheiroijam Landhoni was running the boarding in violation of JJ (Juvenile Justice) Act.

The application prayed the Court to ascertain whether Manipur Shop and Commercial Establishments Act 1972 can be legal for registering the boarding in violation of JJ Act.

Asking for further investigation, it also prayed the Court of the CJM to "identify the perpetrator of the crime by DNA profiling of the blood stain (AB group) found in the middle finger of N Babysana" .

The application also asked the Court to provide the true copies of the report submitted by CBI in the case and also prayed not to take cognizance of the case till the DNA profiling is done and the "criminal" is identified.

The Court then registered the application as a criminal miscellaneous case and fixed May 12 for hearing.

It may be mentioned that N Babysana (14), a Class VII student was found hanging under mysterious circumstances at the boarding inside Standard Robarth Higher Secondary School at Canchipur on July 18, 2019 .

Acting on the directive of the High Court of Manipur on November 6, 2019, a three member team of the CBI, Special Crime Branch, Kolkata was constituted and investigation was started by registering a regular case under Section 305/34 IPC and Section 75 of Juvenile Justice (Care and Protection of Children) Act.

After the completion of the investigation, the CBI submitted its final report before the CJM Imphal West on April 1 recently.

The final report of the CBI had mentioned that charge sheet could not be submitted against the accused persons as no evidence against them emerged during the investigation.
