Firestone man given probation, deferred sentence in unlawful sexual contact case

Apr. 17—A Firestone man accused of forcing a 13-year-old girl to perform oral sex on him in 2019 was sentenced to probation and a deferred sentence as part of his plea bargain.

Dillon Daniels, 19, pleaded guilty in February to unlawful sexual contact and third-degree assault, both misdemeanors.

As part of the plea deal, attorneys agreed Daniels would serve a deferred sentence on the unlawful sexual contact charge, which means if he is able to fulfill the terms set by a judge and not pick up any serious charges for the duration of his sentence, he will be allowed to withdraw the guilty plea.

But if he were found to have violated the terms, he would be found guilty of the unlawful sexual contact charge and subject to sentencing.

On April 9, Boulder District Judge Norma Sierra issued a two-year deferred sentence for Daniels on the unlawful sexual contact charge, as per the agreement. Sierra also sentenced Daniels to two years of probation to run concurrent with the deferred judgement on the third-degree assault count.

According to an arrest affidavit, police were notified in September 2019 about the allegations by relatives of the 13-year-old girl, who knew Daniels through a mutual acquaintance.

The girl told investigators she believed the incident happened in the spring or summer of 2019. The girl said Daniels picked her up and said they were going to go to a park to play football.

But the girl said Daniels instead drove her to Erie Lake, and then asked to have sex with her. When the girl told Daniels she did not want to have sex, he then forced her to perform oral sex on him.

In an interview with police, Daniels admitted to the girl performing oral sex on him, but claimed the girl was the one who came on to him and said she asked to have sex with him over Facebook messages. Daniels also claimed he thought the girl was 16 years old and that the age of consent in Colorado was 15.

But according to the affidavit, police did not find any evidence of Facebook messages between Daniels and the girl. The girl also told investigators Daniels had known her and her family for several years and knew she was not 16.
