TS govt said to submit quota details in local polls

Hyderabad: A panel of two judges of the Telangana High Court, consisting of Chief Justice Hima Kohli and Judge B Vijaysen Reddy, ordered the state to file an affidavit with information on the surveys conducted on reducing the reservations. at local elections.

The panel considered a number of written petitions against the government’s actions to reduce the discussion percentages for OBCs in local elections from 34% to 22%. The council of one of the submitters, Samala Ravindar, argued that one of the prayers is now covered by the verdict handed down in March by a full bench of the Supreme Court, which aims to increase the discussion percentages for OBCs in such elections to increase. The SC has instructed that it is mandatory for every state to follow the 50% ceiling bar for SC / STs and OBCs in local elections.

The Telangana Backward Classes Cooperative Finance Corporation Limited, Hyderabad, conducted a socio-economic survey on the basis of which the state decided on the booking percentages. It has been argued that such a survey falls only within the Telangana State Commission for Backward Classes to discuss percentages for OBCs to ensure their adequate political representation in local bodies. It said the state did not even conduct a survey before the election and relied on the 2011 census. The panel was brought to the attention of the government holding local body elections without following the mandatory conditions laid down by the SC in its 2010 ruling.

According to the ruling, the booking percentages for OBCs in local elections must pass the triple test. The 2018 and 2019 notices issued by the state with OBCs discussion percentages based on 2011 census data are shy of the requirement under the triple test. The panel asked the state to submit an affidavit along with the surveys on which calculated percentages for OBCs are determined. It listed the case for further hearing on April 19.

Contempt profession

The same panel, after taking note of the huge increase in the number of contempt appeals filed, issued guidelines to the court register. It ordered all contempt appeals filed by government officials to provide a history of all contempt proceedings instituted against them. The summary of the history must contain information about the cases in which the person was convicted or acquitted. The same must be submitted by the appellant together with other essential documents.

Job appointment

Judge Abhinand Kumar Shavali ordered the principal of Osmania Medical College to consider the case of Basapally Kranthi Kumar for appointment by moving to the post of Librarian against the vacancies destined for the scheduled caste category by his name along with place others before the departmental promotion committee. The petitioner laid a deed before the court questioning the decision that he would not consider his name for appointment, by transferring it to the said post. After hearing both sides, the judge accepted the said order to dismiss the written petition.
