Italian Marines Case: Supreme Court asks Italy to deposit Rs 10 crore as compensation

A bench of Chief Justice SA Bobde and Justices AS Bopanna and V Ramasubramanian had finally made judgement in the Italian Marines Case.

On Friday, April 9, Supreme Court asked the Centre to deposit in its account the Rs 10 crore compensation given by the Italian government for the kin of the fishermen killed by Italian marines off the coast of Kerala in 2012.

“Supreme Court asks Italy to deposit an amount of Rs 10 crore as compensation, with Ministry of External Affairs (MEA), and after which, a decision would be taken to pay these amount to the families of two Kerala fishermen killed by the Italian Marines,” reports ANI.

Ministry of External Affairs spokesperson Anurag Srivastava said, “The tribunal observed that India and Italy had concurrent jurisdiction over the incident and a valid legal basis to institute criminal proceedings against the marines. However, it found that the immunities enjoyed by the marines as State officials operate as an exception to the jurisdiction of the Indian courts and, hence, preclude them to judge the marines. India has taken note of the award and will be in touch with relevant entities on the matter.”

A bench of Chief Justice Bobde and Justices AS Bopanna and V Ramasubramanian had finally made judgement and asked Italian Marines to deposit Rs 10 crore in the Ministry of External Affairs as compensation.

The Italian government offered to pay a total of 10 crore in damages. The families of the two deceased fishermen have agreed to a compensation of 4 crore each in addition to the 2 crore already paid by the Italian government. The injured owner of the boat had also consented to receiving damages of 2 crore.

A case was filled against the marines Massimiliano Latorre and Salvatore Girone, who were posted on Enrica Lexie, and charged them with shooting and killing two Indian fishermen on board their fishing vessel St Antony.
