Child porn inmate charged with molesting girl

Mar. 22—A Nanticoke man serving time in prison on child pornography charges has been charged with repeatedly molesting a young girl.

Jayson S. Montanez, 34, is accused of molesting the 6-year-old girl while in his care prior to her mother reporting it in July 2014.

Luzerne County Detectives charged Montanez with felony counts of involuntary deviate sexual intercourse with a child, aggravated indecent assault of a child, indecent assault and corruption of a minor.

Montanez was not immediately arraigned because he is serving an 18-36 month prison sentence on child porn charges at State Correctional Institution Houtzdale.

In that case, Montanez pleaded guilty to seven felony counts alleging he had images of girls as young as 2 years old posed in sexually suggestive positions on his cellphone.

Montanez was previously charged in November 2014 in the child molestation case, but the charges were dismissed due to a July 2020 Pennsylvania Supreme Court ruling that held hearsay evidence alone is insufficient evidence during a preliminary hearing.

During Montanez's initial preliminary hearing, prosecutors presented testimony of a former Luzerne County Children and Youth Services caseworker and a video of the child's interview, but the child herself did not testify.

In light of the Supreme Court ruling, the Pennsylvania Superior Court ordered the case dismissed in November.

The preliminary hearing in the new case is now scheduled for April 9.
