Cardin made his remarks to Transportation Secretary Pete Buttigieg at a press conference, not realizing that a C-SPAN mic was recording. “Ultimately, it’s going to be put together similar to how the American Rescue Plan was put together,” Cardin said, referring to the $1.9 trillion coronavirus relief package. “Most likely, we’re going to have to use reconciliation.” Budget reconciliation is a process that allows the Senate to pass legislation with a simple majority rather than with the 60 votes needed to prevent a filibuster. Per Senate rules, the reconciliation process is supposed to be limited to bills that pertain to the federal budget. The Senate parliamentarian ruled in late February that Democrats could not use budget reconciliation to raise the federal minimum wage. President Biden advocated a major infrastructure spending bill on the campaign trail, although Congressional Democrats are still working on the details of the legislation. The administration is considering the first major federal tax hike in decades in order to fund the bill, which will likely cost more than the $1.9 trillion coronavirus relief package. Biden’s campaign proposal included investment in electric vehicle charging stations, expansion of broadband internet access, and refurbishment of affordable housing. “We view infrastructure as the kind of investments this country needs…to succeed in this century and beat China in the global economy, to create the kind of jobs we need,” White House chief of staff Ron Klain told Punchbowl News last week. A bill would include investments in “hundreds of thousands of charging stations for the new generation electrical vehicles,” “power transmission for clean power,” and “roads and bridges and all these other things.” Cardin’s comments come as progressives push their moderate counterparts to reform the filibuster to eliminate the 60-vote requirement for legislation that expands voting rights,.

    A North Carolina school district has issued an apology after an “unacceptable” assignment instructed fourth-grade students to write tweets and hashtags that people living in the state might have written if Twitter existed during the Civil War, resulting in a wall display of pro-slavery hashtags in the classroom. “It should be deeply disturbing to anyone,” said Kimberly Morrison-Hansley, a member of the Union County NAACP chapter and former member of the county Board of Education who became the first black woman elected to the board. A photo of the Twitter wall in a now-deleted post on the Waxhaw Elementary School Facebook page showed hashtags including “Slavery for Life” and a post by a student under the username “@dontStopSlavery” saying “you may not agree with slavery but I do and I’m honest about it,” according to WJZY. Another post by “Confederate4life” reads “why do we need to leave the county. We can stay and our slaves! #SLAVERYFOREVER.” Morrison-Hansley told the Charlotte Observer the assignment was inappropriate for such young children and said the Twitter wall’s lack of context made it appear that the students were posting racist comments, not sharing what they thought people might have tweeted during the Civil War. “District administrators are taking this matter very seriously and met with the entire Waxhaw Elementary staff,” Union County Schools reportedly said in a statement. The school system “is actively developing training sessions for all employees to address diversity, equity and inclusion. We are committed to working with teachers to discuss best practices for instruction.” However, Morrison-Hanley told the paper she is not satisfied with the apology, instead calling for the superintendent and members of the board of education to face the public on Youtube and apologize. She said claiming to address diversity, equity and inclusion is “code word for racism” and said that she told a Union County Diversity Committee during its first meeting that those issues “did not bring us here tonight. Issues of racism are what brought us here and that need to be addressed.”

In 2008 Terry pleaded guilty to one count of possession with intent to distribute 3.9 grams of crack cocaine and sentenced to 15-and-a-half years in prison, according to Reuters. What they're saying: “There is no dispute that Black, Brown, and less well-off persons who were convicted of offenses involving crack cocaine received disproportionate and severe sentences as compared to violators convicted of powder cocaine offenses, said D.C. Attorney General Karl A. Suddenly they're against baring their arms." In fairness to Republicans, they're getting starkly mixed messages, Kimmel added. "The pandemic isn't a big deal, it will wash away, it's no worse than the flu; but it was created by China to destroy us. Which is it? Is Trump not getting the credit he deserves for manufacturing the vaccine, or this how Bill Gates controls our minds? No wonder they're hesitant." Dr. Anthony Fauci "strongly urged Donald Trump to tell his followers to get vaccinated," he deadpanned, "and he probably will, he generally does the right thing." Tooning Out the News was similarly skeptical Trump would follow Fauci's suggestion. "Yesterday on Fox News, Dr. Fauci urged former President Trump to speak up about the coronavirus vaccine," Jimmy Kimmel said at The Tonight Show. Not only will Trump not respond to a direct appeal, he said, but "honestly, asking Trump to give people medical advice makes me nervous because you know one day he's gonna say something crazy like Sour Patch Kids can cure asthma." Fallon made his own Trump PSA just to be safe. "Nearly 30 percent of Americans, and half of all Republican men, say they do not intend to get one of the vaccines," Stephen Colbert said at The Late Show. "First of all, I call dibs on theirs. Second of all, why? Why, Republican men, why? Your guy's the one taking credit for the vaccine even existing. You're insulting him by not getting jabbed!" Fauci used flattery to try to get Trump to step up, he noted, "but to get everyone their shots, we need leadership from every part of the community, which is why thousands of clergy members from a cross-section of faiths — imams, rabbis, priests, and swamis — are trying to coax the hesitant to get vaccinated against COVID-19.   • McConnell Hits Biden’s ‘Bizzare’ Goal of Small Gatherings by July 4th

    Senate Minority Leader Mitch McConnell (R., Ky.) criticized President Biden’s goal that would see Americans able to hold small outdoor gatherings for Independence Day, in a Monday speech on the Senate floor. McConnell characterized the goal as “out of step with science.” The minority leader pointed out that according to current pandemic guidelines from the Centers for Disease Control and Prevention, vaccinated Americans can already gather in small groups indoors without masks, and elderly vaccinated Americans may visit their unvaccinated grandchildren. In his speech on Thursday marking a year since the World Health Organization declared the coronavirus crisis a pandemic, Biden said that Americans may be able to celebrate the Fourth of July in small groups if they continue to follow mitigation guidelines. “This is bizarre and problematic on several levels,” McConnell said. “Let’s be clear: the federal government does not instruct free citizens how they may gather in small groups with their own families….The White House confers a bully pulpit. It does not confer supreme authority over daily life.” McConnell added that in Summer 2020, “many liberal politicians applauded massive outdoor gatherings because they supported a political cause. I’m not sure how much capital these officials have to micromanage backyard barbecues.” (The minority leader was referring to massive demonstrations in protest of the death of George Floyd, an African American man killed during his arrest by Minneapolis police officers.) McConnell’s remarks come as U.S. medical workers are giving a seven-day rolling average of 2.4 million vaccine shots, according to the Bloomberg coronavirus vaccine tracker. Over 21 percent of Americans have received at least one vaccine dose, with over 11 percent of the populate fully inoculated against coronavirus. The number of new daily cases of coronavirus in the U.S. has also dropped significantly since mid-January.

  • Did the Trump White House Create a Batshit Report on Dominion Voting?

But despite the Trump team’s apparent eagerness to tout the report and its claims in December 2020, three months later nobody seems to want to cop to authoring it.Katherine Friess, the Trump legal team volunteer whose name is on the cover page of the report, titled “Dominion Voting Systems Overview 12/2/20,” and in metadata embedded in the document, says she had nothing to do with it. Friess and Bernie Kerik, a former New York City police chief under former New York City Mayor Rudy Giuliani and a volunteer with the Trump legal team, say the report was sent to the legal team by a then-White House aide to former Trump trade adviser Peter Navarro. The former senior Trump official refused multiple opportunities to comment on the record for this story.The difficulty in identifying an author for a report which Trump’s team once seemed happy to brag about underscores the extent to which the looming threat of lawsuits by Dominion Voting Systems has cast a pall over veterans of the effort to overturn the 2020 presidential election. Lawyers for Dominion have filed $1.3 billion lawsuits against Trump personal lawyer Giuliani, pro-Trump lawyer Sidney Powell, and pillow magnate Mike Lindell for their alleged defamation of the company’s voting software, with more suits reportedly on the way.Senior Trump campaign officials including the former president and legal team chief Giuliani publicly aired since debunked conspiracy theories about Dominion, from nonexistent ties to Venezuela to fake “deleted” votes. But Friess and Kerik’s claims that a Trump administration aide shared the report with the campaign’s legal team suggests the White House was even more involved in the effort to raise questions about Dominion’s products.The Dominion report first surfaced publicly in early December in an article on the Gateway Pundit, a pro-Trump conspiracy site. The story claimed that the Trump campaign was using the document to brief state legislators on their claims of voter fraud. The report describes itself “an overview” of Dominion Voting Systems’ “history, executives, vote manipulation ability and design” and “foreign ties,” and repeats a number of claims that have since been discredited, including that Dominion has ties to “several state-run Venezuelan software and telecommunications companies” and that the company’s products use software from another election technology firm, Smartmatic.Here’s How Hugo Chavez, Dead Since 2013, Became Responsible for Trump’s Election LossFriess’ name appears on the cover page and metadata embedded in a PDF uploaded to Archive.org linked to by The Gateway Pundit. In an email to The Daily Beast, Friess insisted that she had nothing to do with the report and didn’t know how her name came to be on the document.“I did not have anything whatsoever to do with the research, writing or production of the Dominion report. I have no idea how my name came to be on a cover page for it, who did that, or why,” Friess told The Daily Beast, claiming that the report was “disseminated” by a member of Navarro’s team.Kerik, who was pardoned by Trump for a host of felony charges and later aided the Trump legal team in its crusade to nullify President Joe Biden’s victory, said Friess wasn’t involved with the production of the Dominion report. “It was actually sent to the mayor’s legal team by [a person with] Peter Navarro’s office [on] 11/29, however, I’m not sure [Peter] saw it before we received it.”Kerik continued, “It is my belief that Navarro did not see it, and I don’t believe he authored it. However, it was sent to me and the legal team via a then-White House aide who worked for Peter.”In a phone call Monday, Kerik read The Daily Beast the email that the “then-White House aide” sent on Nov. 29, but he declined to name who sent it. The Daily Beast has since confirmed that the sender was indeed an official who worked in the Trump White House.Kerik worked alongside Giuliani on the Trump legal team collecting affidavits alleging irregularities in the 2020 election and “liaising with people who wanted to discuss the issue with the president or mayor,” he said. Kerik added that Friess “had never met Giuliani or the president prior to coming in and volunteering to assist in the legal effort. I was the one who introduced her to the mayor. I was in the White House with her the first time she met [Trump], and that was a meeting with Giuliani and [others].”Navarro, a staunch Trump loyalist, also authored three documents, collectively dubbed “The Navarro Report” (“The Immaculate Deception,” “The Art of the Steal,” and “Yes, President Trump Won’), which erroneously alleged widespread voter fraud and irregularities that tipped the election from Trump to Biden.Friess made news recently when her name surfaced as part of a visit by a Giuliani-linked forensic team that traveled to Antrim County, Michigan, in November to copy voter data in connection with a local lawsuit against county officials. The Record Eagle reported that Friess “bragged” about having recently dined with Trump and Rudy Giuliani to local officials, but Friess says she’s never had dinner with Trump and “certainly” has “never claimed to have done so.”Friess says she joined the Trump legal team as “a volunteer attorney, to ensure election integrity, like hundreds of other volunteer attorneys across the country.”According to Kerik, she “assisted in the preparation of legal documents, interviews, and reviewed affidavits; and coordinated travel, legislative hearings and meetings, as directed by the mayor or myself.”Read more at The Daily Beast.Got a tip?   • IRS Failed to Collect $2.4 Billion in Taxes From Millionaires: Report

    The Internal Revenue Service has failed to collect more than $38.5 billion from taxpayers earning more than $200,000 a year — and more than $2.4 billion from taxpayers with incomes over $1.5 million, according to a new report from a Treasury Department watchdog highlighted by Bloomberg News. Bloomberg’s Laura Davison reports: “Auditors were only able to recoup about 39% of the more than $4 billion in unpaid taxes owed by a group of rich taxpayers with an average annual income of nearly $1.6 million, the report found. The findings suggest that the IRS should place more emphasis on a taxpayer’s income when determining whether to pursue an audit case, the Treasury Inspector General for Tax Administration said in the report released Monday. … “The findings are the latest in a series of government accountability reports that recommend the IRS do more to pursue high-income taxpayers after audit rates dipped to historic lows in recent years. The dearth of examinations has prompted Democrats in Congress to pursue legislation that would mandate higher audit levels of businesses and wealthy individuals.” The watchdog report made seven recommendations that it said could help the IRS improve collection from wealthy taxpayers. It suggested, for example, that the agency could use income information to better identify taxpayers who can pay their delinquent taxes. The report found that many high earners owe little relative to their incomes, but said that the IRS does not prioritize income when deciding which cases to pursue, instead placing more significance on factors such as the dollar amount of the balance owed. “It is the IRS’s belief that it is effectively addressing noncompliance by high-income individuals by focusing on the size of the amounts owed,” the report said. “As subsequently shown, this assumption is faulty.” IRS management agreed with just two of the seven recommendations but said it plans to evaluate its models and consider additional income factors to improve its ability to predict recovery of delinquent taxes. Noem, who said "we will not be social distancing" at the event, faced similar pushback. A former fire management officer for Mount Rushmore and six other national parks in the region said the fireworks show were "ill advised" due to "extremely flammable" burning debris, embers and shells, per the Argus Leader.Indigenous leaders deigned it a sign of disrespect. "We are now being forced to witness the lashing of our land with pomp, arrogance and fire hoping our sacred lands survive," Harold Frazier, chairman of the Cheyenne River Sioux Tribe, told USA Today in June. Sheldon Whitehouse, a Democratic senator and former prosecutor who serves on the judiciary committee, is calling on the newly-confirmed attorney general, Merrick Garland, to help facilitate “proper oversight” by the Senate into questions about how thoroughly the FBI investigated Kavanaugh during his confirmation hearing. The supreme court justice was accused of sexual assault by Christine Blasey Ford and faced several other allegations of misconduct following Ford’s harrowing testimony of an alleged assault when she and Kavanaugh were in high school. Kavanaugh denied the claims. The FBI was called to investigate the allegations during the Senate confirmation process but was later accused by some Democratic senators of conducting an incomplete background check. For example, two key witnesses – Ford and Kavanaugh – were never interviewed as part of the inquiry. Among the concerns listed in Whitehouse’s letter to Garland are allegations that some witnesses who wanted to share their accounts with the FBI could not find anyone at the bureau who would accept their testimony and that it had not assigned any individual to accept or gather evidence. “This was unique behavior in my experience, as the Bureau is usually amenable to information and evidence; but in this matter the shutters were closed, the drawbridge drawn up, and there was no point of entry by which members of the public or Congress could provide information to the FBI,” Whitehouse said. He added that, once the FBI decided to create a “tip line”, senators were not given any information on how or whether new allegations were processed and evaluated. While senators’ brief review of the allegations gathered by the tip line showed a “stack” of information had come in, there was no further explanation on the steps that had been taken to review the information, Whitehouse said. “This ‘tip line’ appears to have operated more like a garbage chute, with everything that came down the chute consigned without review to the figurative dumpster,” he said. He also criticized FBI director Chris Wray, who Joe Biden has elected to remain in place, for not answering questions about the investigation. The FBI did not respond to a request for comment. The DOJ did not respond to a request for comment. While it is unclear whether the FBI would re-open an investigation into Kavanaugh, who is now one of nine justices on the supreme court, the letter could push Garland to force the DOJ to respond to questions about the investigation into Kavanaugh. Whitehouse said he is seeking answers about “how, why, and at whose behest” the FBI conducted a “fake” investigation if standard procedures were violated, including standards for following allegations gathered through FBI “tip lines”.
