Colonies on agri land without nod, 18 owners booked

Gurgaon: Cracking the whip on unauthorised development, Gurgaon police on Wednesday registered two FIRs against 18 land owners for developing illegal colonies in Farrukhnagar.
The FIR was registered with Farukhnagar police on the complaint of the enforcement wing of the department of town and country planning (DTCP).
Following the complaint, two FIRs were registered against 18 people, including Dindayal, Keshav Dayal, Jaiparkash, Radhe Shyam, Dinesh Kumar, Suresh Kumar, Manju Bala, Shashi Bala, Indu Bala, Anju Bala, Dharmender, Kamla Devi, Mukesh, Kailash Chand, Khushal Chand, Yogesh Kumar, Umesh Kumar and Dharmender for illegally carving out plotted colony on agricultural land without taking any permission from authorities.
District town planner (enforcement) RS Batth said that the land on which the colony was being developed falls within the notified “Urban Area”. According to the Haryana Development and Regulation of Urban Area Act, no construction can be carried out on land that falls under the municipal area or is notified as “Urban Area” without necessary permission.
“The land on which the illegal colony was being developed falls within the limit of the urban area and it is under the ambit of the Farrukhnagar Municipal Committee,” Batth said.
Batth said that despite a notice from the department, the land owners were deliberately continuing with the development of the colony in contravention of the law. Violation of these laws is punishable with jail term of up to three years and a penalty. The department has requested cops to keep an eye on any unauthorised development.
Batth said that they have been taking action against illegal colonies and multiple demolition drives were carried out. “We had demolished the structures and recommended for registration of FIR against the land owners,” said Batth, adding that they are conducting demolition drives on a regular basis to tackle mushrooming of illegal colonies.
Several land owners in Manesar, Bhondsi, Sohna, Farrukhnagar and Pataudi have set up unauthorised colonies in more than 50 villages without seeking permissions from the government agencies. According to the norms, the tehsil office cannot carry out registration of any property without procuring no-objection certificates from the DTCP.
FIRs have been registered under section 7A and 10 of Haryana Development and Regulation Of urban Areas Act, 1975 against the land owners.
