THANE: The Thane sessions court has rejected the anticipatory bail plea of the in-laws of a female advocate who was found hanging at her house in Diva last year.
The additional sessions judge Shailendra Tambe rejected the pre-arrest bail plea of Sunita Devi Yadav and Ramkisan Yadav, informed prosecutor Vinit Kulkarni.
The prosecutor informed that the deceased Kalpana Yadav was found hanging by her husband in the bedroom of their house on July 20. Subsequently, the accused in-laws were booked under Abetment of suicide of the Indian Penal Code (IPC) at the Mumbra police station. The deceased was a practicing advocate and also a member of the Bar Council of Maharashtra and Goa and a practicing lawyer.
The prosecution also told the court that the husband and his parents were pressuring Kalpana to bring money from her parents hence she committed suicide. The defence counsel for the accused said that there was delay in registering the offence and the custodial interrogation of the in-laws was not required as nothing is to be recovered and discovered from them.
The investigation officer told the court that the accused with common intention demanded money from the deceased and mentally harassed on the ground that she should transfer the room located in Diva in the name of the accused.
Kulkarni pointed out that the investigation was defective and manipulated by the police. Kulkarni in his submission said, “..the photographs of the victim shows many marks on her neck, however, in the hanging there would be one mark which clearly shows that there was struggle before death of victim and the hanging story is false.”
The judge after hearing both the sides said that the pre-arrest bail cannot be granted to the accused in-laws as the investigation in respect of these accused is not completed.
