PIL regarding shifting illegal immigrants: J&K HC directs Govt to file response on measures taken for proper action

Jammu, Feb 10 (UNI) In a Public Interest Litigation filed by Advocate Hunar Gupta Incharge BJP law and Legal Affairs Department, seeking direction to J&K for appointing and issue necessary directions to a Former Retired Judge to hold an inquiry to identify all the illegal immigrants from Myanmar and Bangladesh migrated in J&K.
Division Bench of J&K High Court Comprising Chief Justice Pankaj Mithal and First Puisne Judge Justice Ali Mohammad Magrey after hearing Senior Advocate Sunil Sethi with Advocate Parimoksh Seth for the petitioner directed Government to file a response within a month that what measures the Government is taking or proposes to take to identify and to take proper action with regard to the illegal immigrants.
In the PIL it has been further seeking direction to State to shift all the illegal immigrants from Myanmar and Bangladesh from the State of J&K to any other place as no Refugee Camp has ever been declared either by the State of J&K or by United Nation in the State of J&K also seeking direction for withdrawal of all benefits given to the illegal immigrants of Bangladeshi and Myanmar from the state exchequer and from the scheme and benefits meant for residents of State of J&K and for the last few years there is an abrupt increase in the number of illegal immigrants from Bangladesh and Myanmar.
As per the government version, 13400 Myanmar and Bangladeshi illegal immigrants are living in various areas of the State of J&K.
However, the actual figures are much more than the official figures. It is submitted that in 1982 the Myanmar Government declared them as non-national which led to their migration to neighbouring Bangladesh, Thailand and even Pakistan, however, they were not welcomed in these countries as well.
This led to their influx into India through a porous border with Bangladesh.
Almost 1700 Rohingya families comprising approximately 8500 souls (official figures are 1286 and 5000) live in various settlement colonies of Jammu and Kashmir.
The land mafia of the state of J&K in order to encroach upon the state land natural resources of the state, especially forest areas as well as water bodies, these illegal immigrants from Bangladesh and Myanmar are first settled in forest areas and near water bodies.
It is also submitted that many of the illegal immigrants from Bangladesh and Myanmar have acquired ration card, voter card, adhar cards as well as permanent resident certificates illegally, they are suspected to be involved in various anti-national activities such as drug trafficking, hawala transactions etc. at the behest of enemies of the Nation.
Due to illegal immigrants from Bangladesh and Myanmar, there will be an increase in pro-separatists as well as anti-Indian activities in the State of J&K especially in the communally sensitive Jammu Region which has so far displayed maturity and tolerance.
