The deposit of third or more firearms Under Implementation of the Arms (Amendment) Act, 2019

Chandigarh: Whereas, the Principal Secretary Home Department, Chandigarh Administration has intimated vide E-file no. 13655-HIII(3)-2020/12909, dated 02.12.2020 conveyed a copy of letter no. V-11019/232/2018-Arms, dated 23.10.2019 along with its enclosures received from Second-in-command, Government of India, Ministry of Home Affairs(IS-I Divisions/Arms Section), MDCN Stadium, New Delhi.

The provisions of the Arms (Amendment) Act 2019, notified on 13th December 2019 came into force on 14th December 2019 (copy of S.O.4462 (E) dated 14.12.2019 enclosed. Accordingly, in view of the amendment made in section 3(2) of the Arms Act 1959, the licensee in possession of more than two firearms may retain with him/her any two of such firearms and must deposit the remaining firearm with the officer in charge of the nearest police station or with the licensed dealer or in a unit armory if is a member of the armed force of the Union, latest by 13th December 2020.

The deposit of such a third firearm may be ensured.

Further, it may also be mentioned that as per rule 47 of Arms Rules 2016, the fire-arms so deposited can be disposed of within a period of one year, which may be extended by the District Magistrate by six months and by the State Government by another six months.

This is for the licensee in possession of more than two firearms for information and strict compliance.
