Lincoln Project says it will sue Rudy Giuliani over Capitol riot claims

Following comments by former New York City mayor Rudy Giuliani, Lincoln Project founder Steve Schmidt says the group will take legal action against both him and his client, Donald Trump.

In an appearance on former Trump adviser Steve Bannon’s podcast on Friday, Mr Giuliani accused the anti-Trump former Republican of being playing a role in the organisation of the storming of the US Capitol by pro-Trump rioters.

Mr Schmidt told MSNBC host Ali Velshi that he was “thrilled” at the prospect of suing Mr Giuliani, Mr Trump, and Mr Bannon for defamation.

Speaking on Saturday morning, Mr Schmidt said: “Well, what's amazing about it, Ali is that at the end of it when you cut it off when Bannon goes to, 'you're killing me, you're killing me,' because Steve Bannon knows he's going to get sued by us also, and he is, and so is Donald Trump who is Rudy Giuliani's client, and Rudy Giuliani is acting on his behest.”

He added: “But look, it is very difficult to sue somebody for defamation or libel in the United States, but our lawyers are telling us that Rudy is well across the line so we're thrilled about this.”

As a Republican Mr Schmidt was a key figure in campaigns for George W Bush, Arnold Schwarzenegger, and John McCain, to whom he was senior strategist in the 2008 presidential election.

Mr Schmidt left the Republican Party in 2018, disgusted by Donald Trump’s presidency.

He joined with other conservatives to found The Lincoln Project, the anti-Trump political action committee determined to prevent the re-election of Mr Trump.

Mr Giuliani has made many wild claims regarding the presidential election, Joe Biden’s family, and the storming of the Capitol.

The attack on Congress by supporters of Mr Trump on 6 January led to the deaths of five people on the day and two subsequent deaths by suicide.

A week later the former president was impeached by the House of Representatives for incitement of insurrection for his actions on the day.

His trial in the Senate begins on 9 February.

The Independent has attempted to reach Rudy Giuliani, Steve Bannon, and Donald Trump for comment.

Republicans, meanwhile, backed Raffensperger at around 38 percent, while nearly 45 percent said they disapprove. For context, President Trump received nearly 85 percent support from Republicans, despite his paltry overall numbers. And therein lies the conundrum. The poll suggests a Republican like Raffensperger could mount a challenge in a statewide election in Georgia, but winning a Republican primary to get there looks difficult. And a candidate more in the mold of Trump would have a good shot at winning the primary, but would likely face an uphill battle in the general, seemingly leaving the party in no-man's land for the moment.     New York governor Andrew Cuomo said the issue of coronavirus deaths in state nursing homes had become a “political football,” in his first public comments after Attorney General Letitia James found that his administration had drastically undercounted nursing-home deaths. The state health department in April 2020 altered the way it reported coronavirus deaths among nursing home residents. Residents who died of COVID-19 in the facilities themselves were listed as nursing home deaths, while residents who died after being transported to a hospital were not included in that tally. The change in reporting artificially lowered the true death toll. Health Commissioner Howard Zucker admitted on Thursday night that 3,829 nursing home residents have died of COVID-19 in a hospital since the start of the pandemic, bringing the total nursing home death toll from 8,914 to 12,743, a jump of 43 percent. “Look, whether a person died in a hospital or died in a nursing home, people died.” Cuomo told reporters on Friday. My father “was in a hospital, got transferred to a nursing home. My father died. My father was in a nursing home, got transferred to a hospital. My father died. People died.” Cuomo added, “If you look at New York State, we have a lower percentage of deaths in nursing homes than other states. A third of all deaths in this nation are from nursing homes. New York State, we’re…about 28 percent, but we’re below the national average in number of deaths in nursing homes. But who cares — 33, 28, died in a hospital, died in a nursing home — they died.” (The percentage of nursing home deaths appears to be 30 percent, not 28 percent as Cuomo asserted.) The governor also accused former Trump adviser Michael Caputo for bringing national attention to coronavirus in New York’s nursing homes and using it as a “political football.” “To play politics with it the way they did: that was mean,” Cuomo said referring to the Trump administration. “Because if you lost someone in a nursing home, then it put a thought in your head, ‘Well maybe it didn’t have to be. Maybe my father died unnecessarily.’ And that was just cruel to do, because it wasn’t true.”

Eric Schwan, who died on December 25 at the age of 90, left a large part of his fortune to Chambon-sur-Lignon, a remote mountain village in south-east France that took in some 2,500 Jews fleeing Nazi persecution. The exact value of the bequest has not been made public, but a former mayor of the village told a local website it was more than €2m (£1.8m). “It’s a considerable sum for the village,” Jean-Michel Eyraud, the current mayor, said. A small village of fewer than 2,500 inhabitants perched on a mountain plateau, Chambon-sur-Lignon is famous for the extraordinary courage of its people during the Vichy regime and Nazi occupation. The village's largely Protestant community is known for giving shelter to those in need.

    A US judge on Thursday rejected a last-ditch effort by two men to avoid being extradited to Japan to face charges they helped former Renault-Nissan boss Carlos Ghosn flee the country. The ruling by US District Judge Indira Talwani in Boston cleared the way for US Army Special Forces veteran Michael Taylor and his son, Peter Taylor, to be handed over to Japan, after the US State Department approved their extradition. The Taylors' lawyers had argued they could not be prosecuted in Japan for helping someone "bail jump" and that, if extradited, they faced the prospect relentless interrogations and torture. Ghosn in a court filing sought to support their claim, arguing he faced prolonged detention, mental torture and intimidation in Japan and the Taylors would face "similar or worse conditions". But Ms Talwani said that "although the prison conditions in Japan may be deplorable", that was not enough to bar extradition and that authorities had established their alleged actions were an "extraditable offense". Lawyers for the Taylors quickly moved to appeal. They declined to comment, as did Nissan. Ghosn and the Japanese embassy in Washington did not immediately comment. The Taylors were arrested in May at Japan's request. MS Talwani put their extradition on hold on Oct. 29 so she could hear their challenge to the State Department's decision. Prosecutors say the Taylors helped Ghosn flee Japan on Dec. 29, 2019, hidden in a box and on a private jet before reaching his childhood home, Lebanon, which has no extradition treaty with Japan. Ghosn was awaiting trial on charges that he engaged in financial wrongdoing, including by understating his compensation in Nissan's financial statements. Ghosn has denied wrongdoing. Prosecutors said the elder Taylor, a private security specialist, and his son received $1.3 million for their services.
