Kalka MLA, 14 others sentenced to three-year jail by Himachal court in 2011 rioting case

Shimla: Congress legislator Pradeep Chaudhary, who represents Kalka assembly constituency in Haryana, was on Thursday convicted with 14 others by the court of judicial magistrate, Nalagarh in Himachal Pradesh’s Solan district for rioting. All were sentenced to three-year imprisonment and fined Rs 85,500.
Chaudhary, who had joined Congress in 2019, and others were convicted by CJM Jitender Kumar for rioting, armed with deadly weapon, wrongful restraint, voluntarily causing hurt by dangerous weapons or means, voluntarily causing hurt to deter public servant from his duty, assault or criminal force to deter public servant from discharge of his duty and Prevention of Damage to Public Property Act.
All the 15 convicts, who belong to Kalka and Pinjore in Haryana, were sentenced to concurrent jail sentences of three and two years under Sections 148 (rioting, armed with deadly weapon) and 147 (rioting) of IPC, respectively. They were also fined Rs 20,000 each under these two counts.
Under Section 143 of IPC, all the accused were sentenced six-month imprisonment along with Rs 5,000 fine; under Section 341 of IPC one-month imprisonment along with Rs 500 fine; under Section 324 of IPC three-month imprisonment and Rs 10,000 fine; under Section 353 of IPC two-year imprisonment and Rs 10,000 fine; under Section 332 of IPC three-year imprisonment and Rs 10,000 fine; under Section 435 of IPC three-year imprisonment and Rs 10,000 fine; under Section 3 of PDP Act three-year imprisonment and Rs 10,000 fine and under Section 4 of PDP Act three-year imprisonment and Rs 10,000 fine. All these sentences will run concurrently.
On May 31, 2011, a group of people had attacked the police during a protest at Baddi red light chowk after death of a person. During the attack, several policemen were injured and angry protestors had damaged a police bus and burnt a police vehicle of Baddi police station. A case in this regard was registered at Baddi police station on June 13, 2011.
