The Supreme Court, however, refused to stay the January 5 order of the Karnataka High Court under which it had allowed the criminal complaint against Yeddyurappa to be reinstated.

The bench said in its order to issue notice. Till then arrest will stay in the case.

Senior advocate Mukul Rohatgi, appearing on behalf of Yeddyurappa, said that the appeal raises a legal question whether a court can proceed against a public servant without the prior permission under the provisions of the Prevention of Corruption Act on the basis that He has now relinquished the post he allegedly used for the crime.

He demanded the order of the High Court or stay of the proceedings of the lower court, saying that the process should begin after the High Court verdict.

Rohatgi said Yeddyurappa would be arrested in compliance with the arrest warrant issued by the lower court.

The bench said that you are a sitting Chief Minister. Who can issue an arrest warrant against you? At most, they can issue a letter of request to you. The Supreme Court issued a similar order on Nirani's petition.
