Chandigarh, January 28: Taking action against the erring builders, Haryana Real Estate Regulatory Authority, Gurugram has imposed a penalty of Rs. 2.25 crore on M/s SPS Homes Builders and Developers Pvt Ltd, M/s Vistaar Group Pvt Ltd, and M/s Royal Infra Buildtech Pvt Ltd for violation of Section 3 (1) of the Real Estate (Regulation and Development) Act, 2016 and has directed demolition of unauthorized construction by Municipal Corporation, Gurugram.
The bench presided over by Dr. K.K Khandelwal, Chairman, HARERA (Gurugram), took a stern view that penalty needs to be imposed on the builders and decided to impose a penalty of Rs. 1 crore, Rs. 75 lakh and Rs. 50 lakh respectively on the errant builders. Further, an intimation has been sent to the Commissioner, MCG for demolishing the unauthorized construction in the projects.
Sharing details in this regard, an official spokesperson said that no promoter shall advertise, market, book, sell or offer for sale, or invite persons to purchase in any manner any plot, apartment or building, as the case may be, in any real estate project or part of it, in any planning area, without registering the real estate project with the Real Estate Regulatory Authority established under this Act.
The Real Estate (Regulation and Development) Act, 2016 came into force on May 1, 2017, in its entirety, and the promoters were required to register the project before advertisement/marketing/selling of any plot, apartment, or building, as the case may be, in any real estate project.
Divulging details the spokesperson said that M/s SPS Homes Builders and Developers Pvt Ltd, M/s Vistaar Group Pvt Ltd, and M/s Royal Infra Builtech Pvt Ltd are advertising/marketing/selling the apartments in their projects SPS Homes (Sector-30), Saffron Homes (Sector-67) and Royal Homes (Sector-39) respectively through online portals and indulging in unauthorized construction in their projects. The Authority has taken a serious view on the malpractices being carried out by the promoters in the projects without getting prior registration of the real estate project with the Haryana Real Estate Regulatory Authority, Gurugram, he said. Also, the Authority has taken suo motu cognizance of the matters and has decided to initiate penalty proceedings against defaulting promoter.
This strict action of the Authority will send the right signals to the erring builders and will go a long way in reposing the faith of the allottees in the real estate sector. Such strict action will also act as a deterrent for the other builders who remain non-compliant, towards the Act of 2016 and the directions passed by the Authority as per the provisions of the Act, said the spokesperson. The RERA, Act was enacted for regulation and promotion of the real estate sector and to ensure the sale of plot, apartment or building or sale of real estate project, in an efficient and transparent manner and to protect the interest of the consumers in the real estate, he added.
