Factory owner gets jail in power theft case

Thane, Jan 23 (UNI) The district court disposing off a special MSEB case has convicted a factory owner from Wada of the neighbouring Palghar district for theft of power and sentenced him to two years rigorous imprisonment.
In his order the Judge PP Jadhav also fined the convicted accused Pravin Sureshchandra Jain, 38, a sum of Rs. 31 lakhs.
The judgement was passed on January 20 and copy of the same made available on January 23.
Appearing for the prosecution the Additional Public Prosecutor Vivek Kadu told the court that the engineers of the MSEB conducted a raid on the premises of the Darpan Allied Company situated at Kondala Road, of Wadavali, in Wada, on April 08,2012 and found that the company had taken direct supply of power without a meter.

The raiding team estimated the power theft of 12524 units worth Rs. 10,31,490 for a period of six months.
Accordingly an offence was registered against the accused for theft of power under section 135 of the Electricity Act.
In his order the judge noted that the prosecution has successfully proved the charges against the accused who needs to be convicted and sentenced.

The accused in his submission accused admitted that, Darpan Allied Co. was owned by him and there were machineries having connected load of 100.5 hp. However, he has stated that, the factory was closed and machineries were not functioning. He further stated that, he had deposited Rs.20,00,000/­ within 24 hours. He has specifically alleged that as the work of machinery was not given to local contractor, he is falsely implicated in present crime. The judge in his order dismissed the submission by the accused.

The judge further noted, The complainant power distribution company is entitled for the amount of theft of electricity along with interest thereon. The incident occurred on 08.04.2012. a period of more than eight years has been lapsed. Under such circumstances the civil liability at the rate of 1.5 times of the amount of theft of electricity is just, proper and legal. The power distribution company is entitled of said amount from the amount of fine to be imposed and recovered from the accused.

The judge also noted, “Considering all above facts, the evidence of prosecution and facts admitted by the accused, the prosecution has proved that the accused had taken direct supply in his factory and committed theft of 125424 units of electricity worth Rs.10,31,490/­.
The judge ordered that on realization of the entire fine amount, an amount of Rs. 15,00,000 be transferred to the MSEDCL after the appeal period is over.
