SC notice after Congress holds Leader of Opposition post in Mumbai civic body

BJP councillor Prabhakar Tukaram Shinde had moved the Bombay HC declaring himself as the LOP but the HC rejected his plea on September 21, 2020. He then appealed to SC where senior advocate Mukul Rohtagi argued his case.

NEW DELHI: The Supreme Court on Thursday wondered whether Congress, which is in power in Maharashtra, could simultaneously hold the position of Leader of Opposition in the Mumbai Municipal Corporation. It issued notices to the state, the corporation and the mayor seeking their explanation on the issue.

BJP councillor Prabhakar Tukaram Shinde had moved the Bombay HC declaring himself as the LOP but the HC rejected his plea on September 21, 2020. He then appealed to SC where senior advocate Mukul Rohtagi argued his case.

Rohatgu pointed out that the Cong-Sena coalition was in power in the state. “The LOP is in power in the state,” he said. ““How can you have this? This is completely fatal to democracy.”
