TN Court acquits seven Maoists arrested in arms training case

Dindigul, Jan 19 (UNI) The Principal District Court here on Tuesday acquitted seven Maoists, including two women who were arrested in connection with an arms training case at Kodaikanal hills in 2008 as the charges against them could not be proved by the prosecution.

The case was that a Special Task Force (STF) raided Vadakaunji forest area at upper Kodaikanal hill on April 19, 2008 after getting intelligence inputs that a group of Maoists were engaged in arms training in the forest. During the operation, a Maoist namely Naveen Prasad was killed in exchange of fire with the STF, while the others managed to escape.

The Kodaikanal police registered a case and arrested seven escaped Maoists – Kannan, Neelamegam, Reena Joyce Mary, Shenbagavalli, Kalidas, Bhagat Singh and Ranjith on different dates between 2011 and 2016.

All the seven were booked under sections 147, 148, 121 (A), 124 (A), 153 (A), 153 (B) aqnd 307 read with 149 of the IPC, sections 25 (i)A and 27 of the Arms Act, sections 3, 4 and 5 of the Explosive Substances Act and sections 13(1)(a), 13 (b) and 18 of the Unlawful Activities (Prevention) Act.

During the trial, the police filed a 300-page charge sheet. Out of the 67 witnesses in the case, 44 including the then Home Secretary Niranjan Mardi, deposed before the court. A total of 33 documents were marked.

The prosecution also produced before the court 210 material objects, including the 13 AK 47 rifles used by the STF personnel during the exchange of fire. They also produced a gun that was used by the accused.

Judge Jamuna, who was hearing the case, had announced on December 15, 2020, that judgement in the case would be delivered on January 19.

One of the Maoist Reena Joyce Mary was brought to the court from Vellore Central Prison on Tuesday amid tight security.

The Judge acquitted all the seven Maoists on the grounds that the prosecution failed to prove their involvement in the crime under 16 sections.

Other than Reena Joyce Mary, the remaining accused who could not appear in person, were present through video conferencing facility when the judgement was delivered.
