SC posts hearing of  plea against ten MLAs of Goa Cong defected to BJP

New Delhi, Jan 4 (UNI)The Supreme Court on Monday adjourned for February second week, hearing on petition filed by a Congress leader seeking disqualification of ten Congress MLAs who defected to the Bharatiya Janata Party last year.

A bench headed by Chief Justice S A Bobde averred petitioner Girish Chodankar, president of the Goa Pradesh Congress Committee, that it will take up the matter in the second week of February.



Senior counsel Kapil Sibal, appearing on behalf of the Congress chief argued that the plea seeking disqualification of ten Congress MLAs who had defected to the BJP in July 2019 have been pending with the Speaker since August 2019.

It was listed 18 times in the tentative work-list that is issued by the apex court registry from time-to-time, but never made it to the final listing of cases, he submitted.

Senior advocate Mukul Rohatgi, appearing for the Speaker of the Legislative Assembly, strongly opposed Mr. Sibal's argument, saying Chodankar's petition has already been filed and it can now be fixed for the hearing.



Meanwhile, the bench said that there is no vested interest behind the petition not being listed.
