Delhi HC directs SDMC and ASI to look into the illegal construction near Qutub Minar

In a petition filed by Rishi Sehdev to challenge the construction in close proximity of Qutub Minar, a protected structure by Archaeological Survey of India (ASI), the court observed that “Permission could not have been granted for any construction in the prohibited zone of 100 metres abutting a protected monument.

While Ajjay Arorra, counsel for the corporation argued that on the basis of misrepresentation of facts and fabrication of documents, permission for a building has been taken from the ASI and the Corporation.
Mumbai: The Delhi High Court has directed the South Delhi Municipal Corporation (SDMC) and Archaeological Survey of India to look into the matter of alleged violation of rules that prohibits construction near the protected site of Qutub Minar and has directed the civic authorities to fix responsibility of the officers who may be found to be in dereliction of their duties while permitting such construction.

In a petition filed by Rishi Sehdev to challenge the construction in close proximity of Qutub Minar, a protected structure by Archaeological Survey of India (ASI), the court observed that “Permission could not have been granted for any construction in the prohibited zone of 100 metres abutting a protected monument. The construction has taken place roughly 40 metres from the Qutub Minar, a world-renowned monument protected monument.”

“Let the concerned Zonal Deputy Commissioner of the Corporation also look into the matter and fix responsibility of the officers who may be found to be in dereliction of their duties,” said Justice Najmi Waziri in his order on December 23. “Similarly, the matter be also looked by the Director-General of ASI. The DCP, South too shall look into the matter with respect to the role of the police in this regard.”

Advocates Ashish Chauhan and Vikram Singh Baid, who appeared for the petitioner, argued that they are aghast at the inaction of the Corporation apropos the large-scale construction of buildings immediately next to the Qutub Minar, a monument protected by the ASI.

While Ajjay Arorra, counsel for the corporation argued that on the basis of misrepresentation of facts and fabrication of documents, permission for a building has been taken from the ASI and the Corporation.

The court has also directed the Tree Officer to visit the site and look into the matter and ascertain the position apropos the trees that may have been felled or damaged. Also, the court has asked ASI, SDMC, Delhi Police and the Tree Officer to file their affidavits within four weeks from the passing of the order. The court will hear the matter further on February 17.
